Sullivan stole a knife from a cutlery store at Valley Plaza Mall in Bakersfield, California. He was pursued by a Bakersfield Police officer assigned to the mall. Outside the mall the pursuit was joined by Police officer Erick South and his K-9. Approaching Sullivan, South released his dog on Sullivan. Sullivan stabbed South in the arm.
